BuyHawaii.com is operated by Lapidus, Inc. (“BuyHawaii,” “we,” “us,” or “our”).
By accessing or using BuyHawaii.com, you agree to be bound by these Terms of Service and the BuyHawaii Privacy Policy. If you do not agree, you must not use the platform.
Platform Purpose
BuyHawaii.com operates as a governed self-service advertising, listing, and discovery platform. It is not operated as a social networking service.
Certain content categories, including business listings, event listings, group listings, photo listings, and member directories, may be publicly accessible. Other features require registration or authentication.
Account registration establishes identity and eligibility to use platform features subject to policy, configuration, and compliance requirements. Registration does not guarantee public visibility, discovery, endorsement, participation, or ranking.
Accounts & Eligibility
You are responsible for maintaining the accuracy and completeness of information associated with your account.
Verification, where applicable, establishes eligibility and compliance status only. Verification does not grant public visibility, priority placement, endorsement, authority, or participation rights beyond those explicitly defined by platform rules.
BuyHawaii reserves the right to restrict, suspend, terminate, or modify accounts or content that violate platform policies, applicable law, or compliance requirements.
Visibility & Listings
Visibility of accounts, listings, advertisements, or other content is governed by platform rules, eligibility criteria, moderation processes, and system configuration.
Paid features may increase prominence, prioritization, or placement. Payment does not override eligibility requirements, moderation decisions, or policy enforcement.
Advertising and promotional content must comply with the BuyHawaii Advertising Standards Policy, which is incorporated herein by reference. BuyHawaii reserves the right to reject, remove, or modify advertising content at its sole discretion.
BuyHawaii does not guarantee impressions, clicks, engagement, inquiries, conversion, ranking position, search placement, performance outcomes, or availability of specific surfaces.
Certain features may be limited, informational, legacy, or subject to technical constraints. Visibility outcomes may change without notice.
Payments, Wallet Credits & No Refunds Payments
Certain platform features, subscriptions, advertising placements, listing enhancements, promotional boosts, visibility prioritization, merchandise, and other digital services require payment.
All fees are due in advance. Pricing, billing frequency, and feature access are governed by the applicable plan or purchase configuration at the time of transaction.
Fees may change prospectively without affecting completed transactions.
Wallet Credits
BuyHawaii may offer a prepaid wallet system that allows users to deposit funds for future use on eligible platform features.
Wallet credits:
• Represent prepaid platform usage credits only • Have no cash value • Are non-transferable • Are not redeemable for cash • May only be used for authorized platform features
Wallet balances do not constitute a bank account, stored monetary account, financial instrument, or regulated stored-value account.
No Refunds
All payments are final.
To the fullest extent permitted by law:
• Subscription fees are non-refundable • Wallet deposits are non-refundable • Advertising and promotional purchases are non-refundable • Boosts and listing enhancements are non-refundable • Merchandise purchases are subject to the specific terms stated at purchase • Unused wallet credits are non-refundable
BuyHawaii may, at its sole discretion, issue platform credit in the event of a verified billing error. Any such credit is issued as platform credit only and not as cash reimbursement.
Chargebacks & Payment Disputes
If a payment is reversed, charged back, or disputed:
• BuyHawaii may suspend or restrict the associated account • Wallet balances may be adjusted • Access to paid features may be revoked • Remaining credits may be frozen pending investigation
Outstanding negative balances must be resolved before access is restored.
Expiration & Forfeiture
BuyHawaii reserves the right to establish expiration policies for unused wallet credits or promotional balances.
If an account is suspended or terminated for violation of platform rules, any remaining wallet credits may be forfeited.
Administrative & Operational Accounts
Administrative, moderation, or system accounts exist solely for operational and governance purposes. Any visibility of such accounts does not imply availability for contact, participation, endorsement, or commercial engagement.
Content, Moderation & Removal
BuyHawaii may review, restrict, suspend, remove, or modify content to enforce platform rules, protect users, maintain platform integrity, or comply with legal obligations.
Content removal, suspension, expiration, or eligibility restriction is a governed process and does not guarantee restoration.
Disclaimers
The platform is provided “as is” and “as available,” without warranties of any kind, express or implied.
BuyHawaii does not guarantee uninterrupted operation, visibility outcomes, advertising performance, merchant results, business results, ranking position, or error-free service.
Limitation of Liability
To the fullest extent permitted by law, BuyHawaii and Lapidus, Inc. shall not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from use of the platform.
Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
Changes
BuyHawaii may update these Terms from time to time. Continued use of the platform constitutes acceptance of the updated Terms.
